These Terms of Service ("Terms") govern your use of the Karbala Connect mobile application and website at karbalaconnect.in, operated by Brolytics Technologies ("we", "our", or "us"). By using Karbala Connect, you agree to these Terms. If you do not agree, please do not use the app.
1. About the Platform
Karbala Connect is a community platform dedicated to Islamic religious audio content for the Shia Muslim community. Content on this platform includes Noha (lamentations), Marsiya (elegies), Bayans (lectures), Majlis recordings, and Podcasts created by Reciters, Anjumans (religious groups), Ulema (scholars), and Maulanas. All in-app audio is streamed from files hosted on our own servers at karbalaconnect.in.
Users may listen to licensed religious content hosted and streamed through our platform for personal, non-commercial use.
2. Content Rights and Licensing
All content published on Karbala Connect is managed as follows:
- Admin-curated content: The majority of content is uploaded and managed directly by our team. We obtain explicit consent from the original creators — Reciters, Anjumans, Ulemas, and Maulanas — before publishing their recordings. By granting us this consent, creators authorize Karbala Connect to host, stream, and distribute their content to users of the platform.
- Community submissions: Anjumans and content creators may submit their own recordings through our submission portal. By submitting content, the submitter represents and warrants that: (a) they are the original creator or have obtained all necessary rights and permissions for the content, (b) the content does not infringe any third-party intellectual property rights, and (c) they grant Karbala Connect a non-exclusive, royalty-free license to host, stream, and distribute the submitted content on this platform.
- Original religious content: Islamic religious recitations (Noha, Marsiya) and lectures (Bayan, Majlis) are original works created and owned by the respective Reciters, Anjumans, and Ulemas. Karbala Connect acts as a distribution platform with their knowledge and consent.
All audio files are either sourced directly from the creators with their permission or uploaded by the creators themselves.
3. Copyright and Takedown Policy
We respect intellectual property rights. If you believe any content on Karbala Connect infringes your copyright, please contact us at brolyticstechnologies@gmail.com with:
- Your contact information
- A description of the copyrighted work you believe has been infringed
- The URL or description of the content on our platform
- A statement that you have a good faith belief the use is not authorized
- A statement that the information is accurate and you are the rights owner or authorized to act on their behalf
We will investigate and, where appropriate, remove or disable access to the content within a reasonable time.
4. User Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You may not use another person's account without permission.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to:
- Use the app for any unlawful purpose
- Attempt to scrape, copy, extract, or redistribute content outside the app without permission from the rights holder
- Reverse engineer or tamper with the app or its backend services
- Upload or submit content you do not have rights to distribute
- Harass, abuse, or harm other users
6. Disclaimer of Warranties
Karbala Connect is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or the accuracy of any content. Use of the app is at your own risk.
7. Limitation of Liability
To the fullest extent permitted by law, Brolytics Technologies shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.
8. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the app after changes means you accept the updated Terms.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.
